Inside Kandi Burruss and Todd Tucker’s Explosive Divorce: Custody War, Prenup Drama and New Court Filings
Kandi Burruss and Todd Tucker’s split gets messier as their divorce continues to play out in court — and the latest filings reveal an all-out battle over custody, the prenuptial agreement and what information the public is allowed to see.

According to court documents, Todd Tucker filed its answer to Candy’s filed for divorce on Wednesday, November 26. Todd claimed their two children – Aceborn in 2016, and Blazeborn in 2019 — “is currently in his care and living with him in Georgia,” while Candy handles “out of state work obligations.”
Todd52, argued that those obligations “will continue to require her to be away from the children for at least the next several months,” as he asked the court for primary physical custody, joint legal custody and final decision-making authority. His filing emphasized the couple’s ongoing cooperation, noting, “The parties have worked together in an effort to resolve all issues, and (Tucker) remains committed to continuing these discussions in good faith.”

Todd Tucker’s lawyer praised Candy as mother, with the filing that he “recognizes (Burruss) as a loving and capable parent” and hopes that continued talks “will bring full resolution to all questions.” Still, he suggested “(Burruss) have significant time and meaningful access to the children.
Todd also disputed the couple’s 2014 prenuptial agreement, admitting he signed it but claiming he was pressured to do so without a lawyer present. His application claims that the agreement “was presented to (Tucker), without (TuckerHe also demanded a “division of all marital assets” and alimony if the marriage was unenforceable.

Days later, Kandi Burruss shot back.
The Real Housewives of Atlanta alum filed multiple motions to keep their divorce proceedings sealed, arguing that she and Todd are “public figures working in the entertainment, television and film industries.” Her filing claims it is in the children’s best interest that all financial and custody-related information be kept confidential. Her attorney wrote that unsealing the case would “prevent disclosures on social media, the Internet and the media at large … compromising the integrity of the overall case.”

Todd Tucker has not yet responded to the inquiry.
Candy also submitted an amended petition on December 1st with address Todd’s claims about the preruption. She said he was represented by a skilled attorney at the time and pointed to Bravo footage of their wedding special as evidence. Her lawyer wrote: “The parties’ journey to execute an enforceable prenuptial agreement was filmed and broadcast … with the knowledge and consent of both (Burruss) and (Tucker).” This is noted in the case Todd “audibly announced” that he was “good to sign” the agreement after speaking with his attorney “on and off camera.”

Meanwhile Todd maintained in court that although he received the agreement before the wedding, his lawyer “was not present when he got the final draft.” In her filing, Candy requested joint custody and petitioned for the prenuptial agreement to be confirmed. She acknowledged the couple had accumulated marital debt and said it “should be subject to an equitable division governed by the prenuptial agreement.” Kandi Burruss also asked the court to decide the child support, declaring the marriage “irretrievably broken” with “no reasonable hope of reconciliation.”
The divorce filings continue to unfold as both sides prepare for what appears to be one of them RHOAs most dramatic splits yet.
