One of the most heartbreaking fertility stories in recent times has taken another emotional turn.
The biological parents of a baby girl born to another couple after an alleged in vitro fertilization (IVF) embryo mixing have reportedly decided not to pursue a custody battle, according to multiple news reports this week — despite the immense pain they say they experienced during the ordeal.

According to NBC News Thursday, lawyer Rob Marcereauwho represents the child’s genetic parents, explained that while his clients would have preferred a different outcome, the legal realities surrounding parental rights made the situation extraordinarily difficult. Marcereau told the outlet:
“If it was up to my clients and if they had the choice, sure. But the laws in this country and in Florida favor the parents who actually give birth to a child, so it would have been an incredibly uphill legal battle.”
Instead, the biological parents entered into a custody agreement with the Florida couple Tiffany Score and Steven Millsthe parents who carried and gave birth to the child after what has been described as nothing more than an inexplicable IVF failure.
The case has drawn national attention since Score and Mills discovered that the embryo implanted during fertility treatment was not genetically related to them. It happened after the couple had worked with Fertility Center in Orlando last year to help build their family and believed one of their own embryos had been transferred. But when their daughter, Sheawere born last December, they immediately realized something was wrong.
The couple later pursued genetic testing and ultimately found Shea’s biological parents. Even amid their own shock and heartbreak, Score and Mills previously said they felt a moral responsibility to find the child’s genetic family.
In a previous statement, per People and others, they reflected on the complicated reality they faced:
“This closes a chapter in our heartbreaking journey, but it raises new issues to be resolved… Only one thing is as absolutely certain today as it was the day our daughter was born – we will love and will parent this child forever.”
Legal documents obtained by People state that the two families have now entered into what was described as a mutually crafted custody arrangement. Under the agreement, Score and Mills will continue as Shea’s permanent custodians while the biological parents remain involved in her life.

Marcereau described to NBC News the emotional impact on his clients in stark terms:
“They were obviously shocked to learn that their embryo was used and given to another couple. They are devastated by what has happened and they also understand that the birth couple is also suffering. They had to make the heartbreaking decision not to fight for custody.”
The lawyer told reporters that private meetings between the families reportedly included many tears, difficult conversations and moments of compassion as everyone tried to navigate an unimaginable situation.

speaks to People this week, Marcereau added that his clients ultimately found some comfort in knowing that Shea is being cared for by people they trust:
“They’ve convinced themselves that these people are providing a good home and will be able to take care of Shea. They want to stay in her life, so it’s part of their deal that they’re going to stay in her life and visit and be a part. There was no easy answer or easy solution to this, and they’re doing the best they can under the circumstances.”
Still, the legal battle may not be over. Marcereau told NBC News that the biological parents are expected to file a lawsuit against the fertility clinic and the doctor involved:
“They’ve been put in such a difficult situation that no one should be put in, and the decision they’ve been forced to make has just been agonizing. It’s just inexcusable.”
Meanwhile, representatives for Score and Mills told People they will not comment further as they focus on raising their daughter and developing a relationship with Shea’s genetic parents.

Adding another layer to the story, court documents reportedly indicate that a frozen embryo remains connected to the case. According to legal documents now cited by multiple outlets, that embryo has been transferred to another clinic for storage and future evaluation:
“That embryo will be tested for paternity and then the plaintiffs will determine the next steps.”
The Orlando fertility center announced in April that it would also be closing — with another clinic expected to open in the same location.
And now, regardless of where the lawsuit goes from here, this case remains a devastating reminder of how deeply human the consequences of fertility clinic mistakes can be.
